Introduction

The aim of this project is to provide strategies for Indonesian regulatory bodies to address to the issue of convergence. Convergence refers to a trend in regulation that seeks to define a single regulatory structure for telecommunications, broadcasting and computing. In order to achieve this, the research seeks to provide a clearer understanding of the way that Indonesian regulatory bodies adapt to changes in regulation and regulatory structure

In addition, the literature view undertakes an investigation of comparative cases (Malaysia, the United Kingdom and South Africa) and is used to establish benchmarks. The method used in conjunction with literature review is online focus groups. Key members of MCIT (Ministry of Communication and Information Technology), BRTI (Indonesia Telecommunication Regulatory Body), and KPI (Indonesian Broadcasting Commission) will form this focus group. The aim of the focus groups is to obtain individual professional statements from these members in response to questions delivered to them by email. All members of the relevant regulatory body will be asked to develop a consensus statement that represents their organisation’s position on each question.

Literatures Review

The aim of this paper is to provide, through selective references to some of the literatures, a clearer understanding of the way that regulators adapt to changes in regulation and regulatory structure as well as the way the current regulatory bodies could be better modified to address to convergence.

With regard to the adapting ICT convergence, it has been argued that there are a range of issues that should be considered by regulators and policy-makers. In this literary review, the scope of the reviewed literatures and the definition of convergences are first defined. Then in the review the challenge of convergence for regulators is examined. Furthermore, the requirements that could lead to effectiveness in regulatory agencies are provided. These elements can be used as measures of the way the regulators have power and a strong reputation in regulating the sector. Then, the institutional approach to address convergence is discussed in depth. The following section is to examine the legal approaches to address convergence. The final section covers the conclusions of the literary review.

The telecommunications and broadcasting industries particularly in Indonesia were developed as separate entities through distinct government institutions. Over the years steps have been taken to privatise and liberalise these sectors to varying degrees, but little appears to have been done to integrate them in particular to be one regulatory authority that is responsible for the communication sectors. State of Play in selected countries

This chapter presents the experiences of Malaysia, the United Kingdom, and South Africa in order to address convergence. These countries were selected in this project because they were the fist to restructure their regulatory agencies towards a converged communication regulator. The cases show that the process and the challenges of the reform the regulatory agencies as well as laws in order to address converging ICT industries. In addition, this chapter indentifies the institutional requirements in terms of level of autonomy of the regulatory agency, institutional design option, and legal structure that are driving the governments to consider critical elements to be an effective regulator.
